General Terms and Conditions for Paul Janssen Futurelab Leiden open registration courses which require payment of a course fee. Dated February, 2017. These general terms and conditions (“Terms”) are applicable to the Paul Janssen Futurelab Leiden open registration courses which require payment of a course fee.

  1. Definitions
    • Online course: a Paul Janssen Futurelab Leiden course, in which the learning is done using an Internet-based digital learning platform.
    • Online + On-campus course: a blended Paul Janssen Futurelab Leiden course, which includes an online part and an extended on-campus part.
    • Applicant: a person who has registered for an Online or Online + On-campus course but has not yet been accepted by Paul Janssen Futurelab Leiden.
    • Course participant: a person who participates in a Paul Janssen Futurelab Leiden course.

 

  1. Privacy policy
    • The Paul Janssen Futurelab Leiden privacy policy is in line with Dutch legislation that regulates the use of personal data, namely the Personal Data Protection Act (Dutch: Wet Bescherming Persoonsgegevens).
    • The personally identifiable information (hereinafter referred to as “Information”) that we need from the Applicant for the effective and efficient administration and organization of our courses typically includes full name and title, e-mail address, mailing address, telephone number, information regarding the organization and/or company at which the Applicant is currently employed, and information regarding the Applicant’s education and past work experience.
    • By using the Paul Janssen Futurelab Leiden website, the Applicant consents to the use of his or her Information as described in this section.
    • The Paul Janssen Futurelab Leiden privacy policy covers the use of Information collected both online and offline.
    • Paul Janssen Futurelab Leiden does not sell, rent, or make otherwise available to third parties any Information for marketing or other purposes.
    • If Paul Janssen Futurelab Leiden changes its privacy policy, it will post those changes on this webpage so the Applicant knows what information Paul Janssen Futurelab Leiden collects and how it will be used.

 

  1. Course Agreement
    • These Terms apply to the open registration of Online and Online + On-campus courses that require payment of a course fee.
    • These Terms, together with the submitted course registration form, constitute the entire course agreement (“Course Agreement”) between Paul Janssen Futurelab Leiden and the Applicant.

 

  1. Applicability
    • The Applicant accepts these Terms when submitting a completed registration form to Paul Janssen Futurelab Leiden.
    • The Terms can be found on the Paul Janssen Futurelab Leiden website. The version of Paul Janssen Futurelab Leiden Terms that are in force at the time when the Applicant registers shall apply to the contractual relationship between Paul Janssen Futurelab Leiden and the Applicant.
    • A hard copy of the Terms will be provided at the Applicant’s written request.
    • Exclusion of all or part of these Terms (and amendments and/or supplements thereto) may only be made with prior written consent from the Director of Paul Janssen Futurelab Leiden.

 

  1. Binding agreement
    • Registration for a Paul Janssen Futurelab Leiden Online course is binding upon receipt of the Applicant’s payment for this course.
    • Registration for a Paul Janssen Futurelab Leiden Online + On-campus course is binding upon acceptance of the Applicant for participation by Paul Janssen Futurelab Leiden and upon receipt of the Applicant’s payment for this course.
    • The minimum course requirements for the Online + On-campus course will be posted on the Paul Janssen Futurelab Leiden website prior to the start of the course.
    • The minimum course requirements are guidelines that are used by Paul Janssen Futurelab Leiden to evaluate the suitability of the Applicant for participation in the Online + On-campus course.
    • Paul Janssen Futurelab Leiden is solely authorized to accept an Applicant for participation in an Online + On-campus course.

 

  1. Dissolution of the Course Agreement
    • If the Applicant is not accepted by Paul Janssen Futurelab Leiden for an Online + On-campus course, the Course Agreement will be dissolved.
    • If the Applicant does not pass the online exam in of the online part of the Online + On-campus course, the Course Agreement will be dissolved and the Applicant will be refunded for the on-campus part of the course; administrative costs will be deducted from this refund.
    • The Course Agreement is likewise dissolved if Paul Janssen Futurelab Leiden does receive payment for the course fee before or on the payment deadline (“Due Date”).
    • Paul Janssen Futurelab Leiden will notify the applicant by email in the event of dissolution of the Course Agreement.
    • Article 7:46d, in conjunction with article 7:46i of the Dutch Civil Code (Dutch: Burgerlijk Wetboek), entitles the Applicant to dissolve the Course Agreement within seven (7) working days, with no cost to the Applicant.

 

  1. Course fee
    • The price for each open registration course is posted on the Paul Janssen Futurelab Leiden website. These prices are exclusive of VAT (where applicable).
    • All costs associated with travel, accommodations, and meals, provided they are not part of the specific course description, shall be borne by the Applicant.
    • Paul Janssen Futurelab Leiden reserves the right to modify the course program and/or material and/or replace the instructors in the event of illness and/or non-availability.

 

  1. Payment of the course fee and terms of payment
    • Applicants for the Online course shall pay the course fee via the Paul Janssen Futurelab Leiden website.
    • After admittance to the Online + On-campus course, Paul Janssen Futurelab Leiden will send payment instructions by email directly to the Applicant. The Applicant is responsible for timely payment of the course fee.
    • Paul Janssen Futurelab Leiden must receive payment on or before the Due Date.
    • The Due Date will be posted on the Paul Janssen Futurelab Leiden website at least six (6) weeks prior to the Due Date.

 

  1. Attendance for the blended Online + On-campus courses
    • The “Course Participant” is required to attend all on-campus days of the Online + On-campus course and to participate actively in the course.
    • The Course Participant will abstain from communicating with his/her company/organization (e.g., by phone or email) during the on-campus days of the Online + On-campus course.
    • In case the Course Participant is unable to attend any session of an on-campus day of the Online + On-campus course, the Course Participant will notify Paul Janssen Futurelab Leiden in writing (email), including the reason for absence.

 

  1. Cancellation
    • Cancellations must be done in writing or by email. Cancellation will be valid beginning on the date on which Paul Janssen Futurelab Leiden receives the cancellation notification.

 

  1. Cancellation of an Online + On-campus course by Paul Janssen Futurelab Leiden
    • Paul Janssen Futurelab Leiden reserves the right to cancel an Online + On-campus course if an insufficient number of Course Participants have registered by the registration deadline for that specific Online + On-campus course.
    • For cancellation purposes, Paul Janssen Futurelab Leiden only considers complete applications that are received by the registration deadline.
    • The minimum number of course participants shall be stated in the respective course description on the Paul Janssen Futurelab Leiden website.
    • In the event of cancellation, Paul Janssen Futurelab Leiden will notify course participants by email no later than one (1) week prior to the start of the online part of the Online + On-campus course.

 

  1. Cancellation by the Course Participant
    • If registration is cancelled by the Course Participant no later than six (6) weeks prior to the start of the course, Paul Janssen Futurelab Leiden will refund 100% of the course fee; administrative costs will be deducted from this refund.
    • If registration is cancelled by the Course Participant less than six (6) weeks prior to the start of the course and no later than four (4) weeks prior to the start of the course, Paul Janssen Futurelab Leiden will refund 75% of the course fee; administrative costs will be deducted from this refund.
    • If registration is cancelled by the Course Participant less than four (4) weeks prior to the start of the course and no later than two (2) weeks prior to the start of the course, Paul Janssen Futurelab Leiden will refund 50% of the course fee; administrative costs will be deducted from this refund.
    • If registration is cancelled by the Course Participant less than two (2) weeks before the start of the on-campus course, Paul Janssen Futurelab Leiden will charge the full course fee.
    • If payment is not received by the Due Date, the Course Participant shall be in default.
    • In the case of default, Paul Janssen Futurelab Leiden reserves the right to refuse the Course Participant admittance to the course.

 

  1. Obtaining a substitution for an on-campus course
    • Up to two (2) weeks prior to the starting date of the on-campus part of an Online + On-campus course, the Course Participant shall be entitled to suggest a substitute participant; this request must be submitted in writing to Paul Janssen Futurelab Leiden. The substitute must meet the requirements for participation in the course, including successful completion of the preceding online part and online exam.
    • The final decision regarding admittance of the substitute to the on-campus course shall be made by Paul Janssen Futurelab Leiden.

 

  1. Confidentiality
    • The Course Participant understands and acknowledges the importance of confidentiality with respect to all teaching materials and agrees not to reveal the content of these materials to anyone outside of the course.
    • When registering for a course via the website, the Course Participant will be asked to affirm the statement below:

 

Paul Janssen Futurelab Leiden uses (amongst others) teaching case studies that are wholly or partly based on real-life situations. At the end of the session, we will reveal the results that occurred in real life for the case. We therefore ask that you not reveal the content and/or outcome of these cases with any persons or entities outside the course. As part of this policy, some course materials cannot be downloaded or printed, but can be viewed only on the Paul Janssen Futurelab Leiden website.

 

          I have read and understood the above statement and agree not to reveal the content and/or outcome of the teaching case studies to persons or entities outside the course.

 

  1. Access to learning material by alumni
    • Alumni (prior Course Participants) of Paul Janssen Futurelab Leiden will retain access to the learning materials related to the course(s) in which they participated for as long as the courses are offered and as long as the Paul Janssen Futurelab website is online.

 

  1. Intellectual Property Rights
    • Neither these Terms nor the Course Agreement as a whole are intended to transfer any intellectual or other property right from Paul Janssen Futurelab Leiden to the Course Participant. All of Paul Janssen Futurelab Leiden’s rights (including but not limited to copyrights, trademark rights, titles, and any other commercial rights) remain the property of Paul Janssen Futurelab Leiden’s, without restriction.
    • Course materials provided by Paul Janssen Futurelab Leiden during the course are intended exclusively for use by the Course Participant. These course materials are the sole property of Paul Janssen Futurelab Leiden, unless stated otherwise. No course materials or parts thereof may be reproduced and/or transmitted to third parties in any form or manner, printed, photocopied, microfilmed, electronically copied, or otherwise, without prior written permission by the Director of Paul Janssen Futurelab Leiden.

 

  1. Liability
    • Paul Janssen Futurelab Leiden does not guarantee the completeness and/or correctness of its course materials. Paul Janssen Futurelab Leiden is not responsible for damage arising from any decision or action based upon the course materials and/or on information otherwise provided within the context of the course.
    • Paul Janssen Futurelab Leiden is not liable for any damage incurred by a Course Participant due to cancellation of any or all parts of a course. If a Course Participant incurs damage for which Paul Janssen Futurelab Leiden is deemed liable, that liability shall at all times be limited to a maximum amount equal to the course fee paid by the Course Participant.

 

  1. Applicable law and disputes
    • The Course Agreement between Paul Janssen Futurelab Leiden and the Applicant/Course Participant is governed exclusively by the law of the Netherlands.
    • All disputes in connection with a Course Agreement between Paul Janssen Futurelab Leiden and the Applicant/Course Participant shall fall within the jurisdiction of the competent court at The Hague, the
